I hold a Bachelor’s degree in Law from the University of Kirkuk for the academic year 2003–2004, and a Master’s degree in Law from the University of Sulaimani in 2009. I was appointed at the Ministry of Higher Education and Scientific Research / Kirkuk Technical Institute on 04 September 2011, and since then I have been performing my academic and administrative duties within the institution. During my service, I have participated in several permanent committees, including the Examination Committee, the Scientific Committee, the Summer Training Committee, and the Academic Guidance Committee. I have also taken part in temporary committees such as student reception committees, annual inventory committees, auditing and investigative committees, and student discipline committees. Additionally, I have taught a variety of legal and administrative subjects, including Criminal Law, Administrative Law, Labor Law, Management, and Democracy. At 30th April 2025, I have moved to the Renewable Energy Research Center – Kirkuk, working in the Center’s Legal Unit in addition to my teaching duties in other scientific departments.

الموظف العا م أو المكلف بخدم ة عامة م ن قب ل الحكومة م ا هو إ ل ممثلا لتلك الحكومة فلا يجب إهانته أو التعدي علي ه بالقول أ و الفعل لأي سبب من الأسباب وأيضا لأنه يقوم بخدمة المواطنين ويقدم لهم الخدمات الضرورية في حياتهم اليومية.وهذا ما سنعالجه في هذا البحث وسنبين الية المشرع الع ا رقي والمقارن في الحد من هذه الظاهرة التي اصبحنا نراها كل يوم في مواقع التواصل من انتهاكات واعتداءات لفظية وجسدية على المعلمين والطباء والقوات المنية وغيرهم من الموظفين الحكومين كلها بسبب عدم تفعيل النصوص القانونية . الكلمات المفتتاحية:الموظف العام الحماية القانونية جريمة الاعتداء الصالح العام عقوبة A public servant or one assigned to a public service by the government is a representative of that government, so they should not be insulted by words or actions because they serve the citizens and provide them with the necessary services in their daily lives. This is what will be addressed in this research, and we will explain the methods of the Iraqi and foreign legislators in reducing and limiting this phenomenon, which we see every day on social media where violations, verbal and physical attacks on teachers, doctors, security forces or other government employees take place, all because of the lack of efficiency of legal texts. ضمن موضوع البحث دراسة عن الإهمال و الانحراف الذي يتعرض له بعض الأطفال وذلك بسبب إهمال و تقصير الوالدين إذ ارتأينا البحث في الموضوع من خلال تحديد سلوك الوالدين الذي يؤدي بالأطفال إلى الإهمال و الانحراف و مطابقتها مع النصوص القانونية التي تجرم السلوك مع بيان السلوك المنحرف و الذي لم يجرم في القانون الجنائي مما يؤدي بالأطفال إلى الانحراف وتم تحليل الأحكام القضائية التي تتعلق بالموضوع لما لها دور كبير في فهم النصوص القانونية. وقد تم تقسم موضوع البحث على شكل مبحث تمهيدي تضمن دراسة مفهوم الطفل في التشريع العراقي ليكون فكرة موجزة عن معنى الطفل و مفهومه في القانون العراقي بشكل عام و بعدها تم وضع مبحثين تضمن الأول بيان السلوك الذي جرمه القانون الجنائي العراقي الذي يقوم به احد الوالدين تجاه أطفالهم و الذي أودعهم الخالق سبحانه و تعالى لديهم كأمانة يجب المحافظة عليهم و سواء كان هذا السلوك عمديا أو غير عمدي و تضمن المبحث الثاني من الدراسة العقوبات و التدابير المفروضة على السلوك المجرم و الذي تم بحثه في المبحث الأول إذ تم تحديد المواد القانونية التي تجرم كل سلوك على حدة و معرفة المعنى الحقيقي لروح النص القانوني من خلال تحليل الأحكام القضائية التي صدرت بحق الوالدين عند إهمالهم و تقصيرهم تجاه الأمانة التي بين أيديهم وذلك بإتباع المنهج التحليلي و التفسيري لنصوص القانون وفي نهاية البحث تم وضع خاتمة تضمنت النتائج التي توصل إليها البحث و ذكر التوصيات التي نراها ضرورية لإيجاد الحلول من قبل السلطة التشريعية بوضع نصوص قانونية تحمي الطفل بشكل أكثر من بعض السلوكيات التي لم تجرم أو لم يتم وضع نصوص قانونية تنظيمية لإدارة المؤسسات التي تحمي الأطفال و كذلك تضمن بعض التوصيات التي تحث على الاهتمام الكبير من قبل
